My parked car was hit by a drunk driver

In the middle of the night an elderly lady crashed into my parked car. The CHP had my car towed after the accident and stored at a lot since they cant leave a totaled car in the middle of the street.  My car has been in the lot for over a week and her insurance company says that I need to pay the $800 to get it out since they don’t cover that. Is this right? My car wouldn’t be in the lot in the first place if the drunk driver didn’t hit my car. In the meantime Im going to seek a lawyer to sue her insurance company.  Do you think this is the right way to go to get more restitution for this whole situation?

Lane change accident , or was it?

Hello, I am my wits end and I will try to brief as possible. The incident occurred in Houston Texas last month.
My statement to both insurance companies as follows:
1) Traveling the speed limit at 65mph in the second right lane of a 4 lane highway.
2) Moved to the right lane after signaling and checking all mirrors. Plus looking over my shoulder.
3) The vehicle that eventually hit me had exited the highway prior to my change of lanes as the lane was clear.
4) As soon as I completed the lane change I was hit in the Right rear door and quarter panel. The Other vehicle sustained front bumper to the left side and radiator damage where fluid had drained to the pavement. There was no side damage to the Left front fender door or rear of his vehicle.
5) I was spun around and ended up on the exit ramp facing the wrong way about 50 yards down the road from the other vehicle. There are skid marks showing where I crossed the area of concrete between the highway and exit ramp. The other vehicle was also on the exit ramp about 10 yards from point of impact.
6) The other drivers insists I changed lanes into them
7) The police came but gave no tickets or completed an accident report. They gave us both the Texas “Blue” form.
8) The damage to my vehicle is quoted at $4500 – $5000 by two body shops. The body shops also wanted to know “WHAT KIND OF VEHICLE HIT ME”
9) The other Drivers insurance is denying any liability since there where NO Witnesses and NO Police report and our statements are conflicting.
10) My insurance is denying Liability based upon photos supplied by the body shop and body shop statements on how the damage occurred.

My question is related to the pursuing the insurance company of the Driver of the other vehicle. The Driver is a 19 y/o kid on his divorced dads policy. If I took them both to small claims I probably would end up without a penny as they could not likely pay. What should I do and how would I pursue the other drivers insurance. I only have Liability on my vehicle so the insurance company wont fight for me. THERE WERE NO INJURIES.

Insurance Adjuster

I was sitting still to make a left into my driveway on a 2 lane highway when a truck hit me going at least 70mph, that’s the speed limit and this is Texas. We were the only 2 vehicles on that side of the road, and he was about a 1/2 mile behind me when I was stopped. He claimed he didn’t see me, but also said he was on the cell phone not paying attention. I’ve got witnesses from the other direction who saw the wreck. Of course, my body hurts but its more in the neck and my left arm.
Now, I’ve got a letter from the adjuster claiming its just for the truck value(property damage release), but it sounds like it reads as if I’m releasing all and any claims.
This is the first time I’ve ever been through anything like this, and don’t like how his claims people have dealt with me so far. What do I do? What are my rights?

Tree Totalled My Car need suggestions for Insurance claim

QUESTION: I live in Rochester NY and last night a tree fell and totaled my car. We have pictures of the tree before and part way through the removal process.

My auto insurance wont cover the damages because I only have liability and the landlord’s homeowners wont cover it either. The tree came from the the next lot over that is beyond the property line and the owners recently acquired it.

Are the new property owners responsible for the damages to my car? The plot of land is all swampy and marsh if that makes a difference.

ANSWER: Hi Danielle, unfortunately for the new owners they are responsible for the damages through their homeowner’s insurance policy.  Start by making a claim with them and if there was some sort of overlapping period of insurance then it is even possible that the former owners could be in the claim as well.  I am sure that if the new owners had a mortgage the bank or mortgage lender would have insisted on homeowners insurance being a prerequisite for the mortgage loan.

Hit and run from stolen car

I live in NYS. My car was parked in my job parking lot when someone broke into cars and rear ended my car on there way out of our parking lot. The police found the car and found out it was reported stolen and had out of state plates. When I called the insurance company I found out that the person carrying the insurance policy did not pay the bill and it was cancelled a month ago.
I was not aware of this at the time. My car has rear end damage. Is there anyway to get my repairs covered from the insurance of the stolen car or NYS Crime Victims or MVAIC? Or am I out of luck and responsible to pay it myself. The person who stole the car has not been found.
Any advise would be great.
