worker and use of company truck
i had 2 persons working for me and one of them was responsible for driving the truck, since the job was far away the driver was suppost to take the truck to his house but he did not, he let the other person take it to his house. Later that night he went to rob somebodys house and got caught, now the owner of the house wants to sue the company for what the person has done, but the person had no permission to use the truck, is it possible for the owner to do this

Medicare effective dates, etc…
My mother was recently diagnosed with lymphoma. Instead of being treated at a in network facility we decided to have her treated at MD Anderson in Houston (an out of network facility). She turned 65 in April and is covered by Aetna at her work (approx 35 employees). She does have Medicare Part A but does not have medicare Part B. She does have out of network coverage at Aetna and they have approved the admission (but apparently are not considering the inpatient facility an in-network participating provider).
Questions:
1. Generally, will Medicare A pick up the hospital (non-physician) costs that Aetna does not pay?
2. Since she has left work (last week), would it be more beneficial to enroll in Medicare Part B and purchase a supplemental to cover the costs of this inpatient stay? Can the effective date be the first day of July for Part B and the supplemental?
3. Can we purchase Part B to cover the non-Part A costs while she still has Aetna at work? She could potentially retire with an effective date of June 30th, or she could take Family Medical Leave for 12 weeks. We have several options but just need to be sure which one is most cost effective.

doctor didn’t submit timely claim to medicare
I am trying to figure out the rights and duties in regards to doctors and getting medicare to pay for things. My aunt had a procedure done. The doctor charged her $5,000.00 and said it wasn’t covered by Medicare. We now have established that it is covered by medicare, but now its two years later and too late and medicare won’t cover it because the claim is too late. My aunt wants to sue the doctor who says now, that yes it was a covered procedure, but we were misinformed by people at medicare that it wasn’t covered. My aunt wants her $5,000.00 back from this doctor. Whose duty is it in regards to having Medicare pay or not pay for a procedure. Does my aunt have a cause of action against the doctor? TV replacements
Hi – I saw your response to Bonnie in June about replacing a damaged tube tv with a comparable tv available in today’s market where all tvs are newer technology with widescreen aspect. In a nutshell, I am in dispute with my insurer re the replacement of my 36 inch tube tv (aspect ratio of 4:3) that was damaged by lightening. The full screen size of that tv in square inches was around 1,050. The insurance wants to replace it with a 37 inch wide tv with aspect ratio of 9:16 (the only kind now available). This tv has a total area in square inches of around 560!
I contend that I am entitled to a replacement tv that is closer in total screen size to the one that was damaged. I am asking them to replace with a widescreen tv that is 42 inches diagonally, which computes to around 950 square inches of screen area.
They are fighting me tooth and toe-nail on this. What is your opinion? I am only asking to get a tv that is similar in size to the one I lost.
ps – my old tv was also HD and flatscreen – it came at the very tail-end of the manufacture of tube tvs.
pps – the dollar difference we are contending is only around 400 dollars.

Liability Claim – Negligence
A contractor for my electric company mis-located an underground electric line. The mis-located line was struck and forcefully pulled from my electric meter by another contractor. This resulted in the loss/damage of some electrical applicances within my home. On the same day, another contractor hired to repair the electric line to my home did not repair the connection properly, and therefore additional damages were incurred. Now my electric company, who claims they are indemnified, but has been aiding in the communication with the two contractors, tells me that my computer must be depreciated. Though, replacement cost (ACV) is greater than their offer.
What will the law allow? Should the contractors be liable for the “actual replacement cost” of the computer, or will the law allow for them to pay a depreciated sum?
Last offer looks like this:
* Computer cost $2950 in 2005
* Cost to replace computer is $2200
* They are depreciating the PC by $580 per year (3 years)
* They are offering $1160 for the PC
Does this sound right?
