Accident Medical Bills

“I was a passenger in a car accident. The other party is 100% liable. I retained an attorney for this matter who is working for 1/3 of the moneys received. I have no insurance and went to the ER the night of the accident and received a hefty bill, just under $5000. I’m also being treated by a chiropractor 3 times a week. I’m in California by the way. When this settles, am I likely to receive any additional moneys on top of my medical expenses? or is there a possibility that my medical bills will be so high that after paying my attorney, I could actually be in the hole?”

auto vs bicycle

my wife was just starting to turn left on the green turn arrow when a bicyclist speeding across 3 stopped lanes of traffic tried to cross before the three lanes got their green light.  meanwhile, she did not notice the inner left lane turning left, and crashed into my wife’s vehicle on the right side.  the police cited the bicyclist for failing to yield the right of way, and said that she was taken to the hospital as a precautionary measure.  meanwhile we have been told by our auto insurance that we are out the deductible to repair the car.  would this girl’s parents’ auto coverage be responsible to reimburse us if she is a covered driver?  thanks

auto insurance coverage when driving other car

QUESTION: my son had an accident while driving his freinds car. He had been given permission to drive the car by his friend, but it turns out that his friends insurance only covered the friend to drive the car. my insurance only cover our cars and my son to drive these cars and does not cover him to drive other peoples cars. he was not cited for the accident. is my son (18) or are we liable for the damages to the car?

ANSWER: Hi Mike,

Generally, you can loan your vehicle to anyone and they are covered. I don’t understand why your son would not be covered while driving his friends car. In some states there is what is referred to as “named driver” insurance. So it is possible that the friend had this type of insurance. This would mean that only the “named driver” is covered.

You did not mention if your son was found to be at fault in the accident. If he is found to be at fault, he will be responsible for that damage to his friends car as well as the car that he hit. You will not be liable since he is 18 years old.

If your son if nound not to be at fault, then the at-fault person or their insurance will be responsible for the damage to the car your son was driving as well as their own vehicle.

I believe you are correct – his friend must hacve had the “named driver insurance”.

Actually the friend had given my son permission to drive so he assumed he was covered. While driving he swerved to avoid a coyote and flipped the car. The policeman did not give him a ticket after the accident since that road has a lot of coyotes along the road at night and there had been several similar accidents over the previous weeks; so I am not sure if he is considered “at fault”. if he was not at fault – would you have to blame the coyote… :-)

Car Damaged by Valet

Hello,

I had my car parked for 8 days at a valet airport parking lot. When I dropped it off, there was no damage to my vehicle. When I picked it up, there was damage to the rear, passenger side bumper and wheel-well.

The parking company had their own claim form. I submitted a claim with them, and they denied the claim. I submitted an appeal to their claims manager (with pictures of the damage), and they denied it again. They believe that the damage was pre-existing. They suggested calling my own insurance company.

I called my insurance company. They said that I would not be at-fault, but I would have to pay my $500 collision deductible. My wife was traveling with me, and was the first person to notice the damage. However, the insurance company said we need an “independent” witness in order for them to pursuit the parking company.

The car is a leased 2008 Pontiac. It is only 2 months old, and has only 1000 miles on the odometer. I do not feel that I should be responsible for the damage. I am going to a collision shop to get an estimate to repair the damage. I believe that I have a couple of options:

1. Avoid the insurance claim, and pay for the repairs myself.
2. Submit an insurance claim, and pay my $500 deductible.
3. Get the damage estimate, and take the parking company to small claims court.

Should I even attempt to take the company to small claims court? If there was no “independent” witness, am I likely to win the case? Would I be able to recover the cost of court fees?

Or, do you have any other suggestions?

if/when to involve a lawyer in auto insurance claim

Hi Richard,
I was a pedestrian hit by a car and have a fractured tibia. Driver accepted responsibility in the police report and the insurance company rep told me on the phone they accept responsibility. This happened 3 weeks ago and i am trying to work and manage my daily life, certainly it is a readjustment. I am not happy with the care I am receiving in my HMO (i am myself a family doctor). Is it reasonable to get a 2nd opinion on my treatment? How would getting a lawyer now change how i manage my daily life now? Should i get a lawyer at all?

Driving someone elses vehicle

My Daughter was asked by her freind to drive home from a lunch in her car, which she agreed to do. On the way she hit a car stopped at a light from behind. The persons car was not damaged and they left the scene with out exchanging any information. My daughters friend doesn’t want to go to her insurance company in fear the rates will be increased. Both girls are 18 and only driving about a year. What should my daughter do to protect herself from legal problems and should she pay the damage repairs on her freinds car?

Diminish value……

Hello Richard,
I was rear ended very badly on May’ 08. I was driving a BMW 325i 2006 model. It went for a 12,000.00 repair for a month and was returned back to me. I also had to go to doctor for lot of time I still have pain in the shoulder. Firstly do i sound like a good candidate for diminished value for the car and should I get an attorney. Should I hire an attorney for the shoulder pain.

Direct Line – Claim procedures

Few days ago my car was stolen, police found it. My car was in Dragon Ltd it’s some company which keep cars for police. So police took finger prints, and today morning I got message that they took my car to some different company which keep the car until garage take it. The problem is that nobody can answere me on my questions, when I ask how long does it take to ort things out nobody knows, when I ask when insurance will repair my car nobody knows. Today Direct Line told me that in next week they make appointment with claim advisor to write report about how my car was stolen. I’m quite confused, I have only 5 weeks to my holiday and till this time my car have to be repair.

Do you know how long does it take to sort things out ??

My parked car was hit by a drunk driver

In the middle of the night an elderly lady crashed into my parked car. The CHP had my car towed after the accident and stored at a lot since they cant leave a totaled car in the middle of the street.  My car has been in the lot for over a week and her insurance company says that I need to pay the $800 to get it out since they don’t cover that. Is this right? My car wouldn’t be in the lot in the first place if the drunk driver didn’t hit my car. In the meantime Im going to seek a lawyer to sue her insurance company.  Do you think this is the right way to go to get more restitution for this whole situation?

Insurance Co. dragging feet

I was involved in an accident over two months ago.  After filing with his company, the other driver was convicted of improper driving, etc. and I was told by the adjuster on the case that he was ‘recommending they [his company] accept liability’.  However, it really seems as though they are dragging their feet and I rarely, if ever, can get in contact with the adjuster on my case.  How long it “too long” for getting my car fixed?  Is there anything I should do (eg, suggest legal action or a better business bureau complaint) to motivate them to close the case and get my car fixed?
